Is Probate Always Required?
When a person passes away, probate is almost always required.
But there are a few circumstances where probate is not required. But those are only situations where:
- The person who died did not own any real estate; and
- He or she also owned possessions and accounts with a total value less than $100,000.
If the person who passed away own any real estate, or if he or she owns other possessions and accounts with a value in excess of $100,000, then probate will be required.
