Question 2: Must I leave anything to my child?

  • Do I have to leave anything to my children?  My spouse? Idaho law permits a person to leave their belongings to anyone they choose.  There is no legal requirement that things be left to children or even to a surviving spouse.  But note that each member of a married couple only “owns” half of the property which they acquired during their marriage.  So a Will that leaves property to others will only apply to half of the property which the couple acquired while married.  It also will apply to all property which was brought to the marriage by the person making the Will and to any other property received by gift of inheritance during the marriage.
