  • How can I avoid losing my estate to Medicaid liens?  The Medicaid program is intended as a safety-net to provide assisted living facilities for the elderly.  But it is a benefit that is intended to become available only after one has exhausted one’s own assets.  Consequently, the federal government has made it almost impossible to retain your property while avoiding those liens.  The only realistic way to do so is to give away your property with no strings attached and then be sure to live at  least 3 (and probably 5) more years before you pass away.  But please beware:  This approach is fraught with dangers   If you are interested in exploring such a possibility, we would be happy to refer you to another law office which practices in the area of Elder Law for further assistance.
